Mumbai, Oct 15 – A tense hearing in the Delhi High Court turned into a courtroom drama over the late industrialist Sunjay Kapur’s property. The case pits Sunjay’s third wife, Priya Kapur, against his children Samaira and Kiaan – legal heirs who are fighting over the estate.
Difficult defense for the disputed will
Priya’s lawyer, Rajiv Nayar, tried to defend a will that the children say is full of mistakes and dates back to March 2025. He argued that Samaira and Kiaan had not formally challenged the will in their partition suit. The judge, Justice Jyoti Singh, said the argument was all about form, not the real substance. She questioned how the siblings could oppose a document they never actually saw.
When Rajiv claimed that the plaintiffs’ suit was “not maintainable” because they had not asked a court to declare the will invalid, Justice Singh asked, “Did the plaintiffs receive a copy of the will on July 30, or was it just read out to them?” Rajiv replied it was only read aloud. The judge then replied, “If they never saw it, how could they challenge it?”
Evidence of forgery
Senior Advocate Mahesh Jethmalani, who represents Samaira and Kiaan, said the will was “false in spirit and intent.” He pointed out clear errors that would not happen in a document signed by someone as meticulous as Sunjay Kapur. Jethmalani described the will as a “forged hand” that tried to erase Sunjay’s own children and his mother from his legacy.
The children’s claims
Samaira and Kiaan say they kept in touch with their father through visits, video calls and frequent messages. They argue they were well aware of the will’s contents. The siblings have asked the court that each of them receive a one‑fifth share of the property, which they claim is their rightful inheritance.
The case continues as the Delhi High Court weighs the arguments, the credibility of the will, and whether Priya Kapur’s version is legitimate or a back‑door attempt to grab the estate.
