Delhi HC quashes FIR against man accused of assaulting doctor, orders community service at same hospital

In a recent ruling, the Delhi High Court dropped criminal charges against a man accused of attacking a doctor at a city hospital. The court took this step after the two sides reached a peaceful agreement, but with a catch: the man now has to give back to the community by helping out at the same hospital.

The case dates back to July 2019, when Vipin Ahuja, who was looking after a patient at Dr Sushma Jindal Hospital in Dilshad Garden, got into a heated argument. Police filed an FIR at Anand Vihar station, charging him under Section 506 of the Indian Penal Code for criminal intimidation, plus Section 4 of the law that protects healthcare workers from violence and property damage. Authorities said Ahuja caused a disturbance, hit the on-duty doctor, and interrupted hospital operations with a group.

Fast forward to this year: Ahuja’s lawyer told the court about a settlement agreement signed on January 8, 2025. The doctor, the main complainant, said she no longer wanted to press charges. Both Ahuja and the doctor showed up in court—him in person, her via video call—and confirmed the deal was totally voluntary.

Justice Ajay Digpaul, hearing the case solo, agreed that dragging out the trial wouldn’t help anyone. But he didn’t let it slide without a strong message. “Assaulting a doctor in a hospital doesn’t just put medical staff at risk—it can mess up urgent care for other patients too,” the judge noted, highlighting the dangers of violence against healthcare professionals.

So, the court quashed the FIR, but only if Ahuja completes one month of community service. Starting September 27, he’ll work every Saturday and Sunday at the hospital, right under the doctor’s watch. The hospital’s medical superintendent has to certify when he’s done and send proof to the court.

If Ahuja skips out, acts up, or doesn’t follow through, the superintendent must alert police right away. That could bring back the charges. With these rules in place, the court closed the petition and any related requests. This decision underscores how settlements can resolve disputes while promoting accountability in cases of hospital violence.
