Bengal school job case: Calcutta HC asks how WBSSC determined criterion of ‘untainted’ teachers eligible for fresh recruitment

On Friday, a lone judge in the Calcutta High Court examined how the West Bengal School Service Commission chose to treat the “untainted” teachers who had lost their jobs from the 2016 panel as eligible for this year’s new secondary and higher‑secondary teacher recruitment.

Earlier in April, a Supreme Court division bench struck down the 2016 WBSSC list of roughly 26,000 teaching positions, directing that only the “untainted” teachers could join the 2025 recruitment while any “tainted” teachers—those conclusively found to have received paid postings—were barred from the process.

Consequently, WBSSC organized separate written tests for the new secondary and higher‑secondary teacher slots in September, and results for both exams have just been announced.

But once the shortlist for higher‑secondary teacher interviews appeared, a petition was filed before Justice Amrita Sinha’s bench, claiming that certain “tainted” teachers from the 2016 list had made it onto the interview list.

The petitioner said this directly contravened the Supreme Court’s April ruling that excluded “tainted” teachers from the new recruitment.

The case was heard in the afternoon session of Justice Sinha’s bench on Friday, where she probed how WBSSC decided that the job‑losing, “untainted” 2016 teachers were to qualify for the upcoming recruitment.

She also asked on what criteria WBSSC would apply in granting the 10‑mark weighting for prior teaching experience.

Justice Sinha noted that it appeared some eligible applicants might have been sidelined by the new recruitment rules.

But no definitive orders were issued by her bench on this point.

The next hearing is scheduled for December 1, when attorneys for the state and for WBSSC will argue the case.
