New Delhi, Dec 11 (LatestNewsX) – The Supreme Court has asked Punjab National Bank (PNB) and State Bank of India (SBI) to answer questions about a resident of Uttarakhand whose CIBIL score has allegedly turned negative because of PAN duplication and incorrect reporting.
Justices K.V. Viswanathan and S.V.N. Bhatti, hearing a special leave petition (SLP) presented by Rajendra Singh Panwar after the Uttarakhand High Court declined to act on his earlier contempt plea, sent notices to both banks. The notices require them to file detailed affidavits.
Panwar says he has never taken a loan, yet his CIBIL score shows a negative record since 2020, making him ineligible for any credit. He claims that two other people with the same name share his PAN, and that their defaults may have been mistakenly recorded as his.
Senior advocate P.S. Patwalia, who represents Panwar, told the bench that even after the Income Tax Department issued him a new PAN, the negative score remains because the new number still carries the old PAN’s data.
The CIBIL Bureau replied that it is merely a “collating agent” and only reflects the information supplied by banks.
Since the banks’ responses are needed to resolve the dispute, the bench instructed PNB and SBI to confirm whether Panwar has ever obtained a loan or has any default on record. The matter will be heard again on January 9, 2026.
The SLP arises from earlier proceedings before the Uttarakhand High Court. Panwar first challenged CIBIL’s lack of action in 2020, when the High Court ordered CIBIL to decide his case within three months. A later contempt petition was dismissed after CIBIL Chairman M.V. Nair informed the court that a decision had already been made.
In 2024, Panwar again approached the Uttarakhand High Court, claiming the 2020 order had not been honored. On August 7, a single‑judge bench led by Justice Manoj Kumar Tiwari dismissed the second contempt petition, noting that CIBIL had already acted on his representation and therefore there was no need for a new enforcement notice.
Having been denied the chance to reopen the contempt case, Panwar filed the SLP with the Supreme Court, which is now requesting responses from PNB and SBI.
