Maharashtra Assembly passes bill to provide relief in stamp duty disputes

Nagpur, Dec 12 (LatestNewsX) — The Maharashtra Assembly unanimously approved a bill on Friday that will amend the Maharashtra Stamp Duty (Second Amendment) Bill 2025, aiming to help ordinary people with stamp‑duty disputes.
The proposal introduces a simpler route for citizens to appeal directly to the state government instead of filing a writ in the high court. State Revenue Minister Chandrashekhar Bawankule presented the bill in the assembly, and lawmakers Bhaskar Jadhav and Atul Bhatkhalkar voiced their opinions before the bill was passed unanimously.
“As per the provisions of the existing ‘Maharashtra Stamp Act, 1958’, the order passed by the Chief Controlling Revenue Officer could be challenged only by filing a writ petition in the High Court. This increased the burden of cases on the High Court and the legal expenses of the parties. Also, the revenue of the state government was stuck for a long period due to the pendency of cases in the court. As a solution to this, a new ‘Section 53B’ has been inserted,” Minister Bawankule said.
Under the new clause, anyone affected by a decision from the Chief Comptroller Revenue Authority now has 60 days from the order’s receipt to file an appeal with the state government. A fixed fee of Rs 1,000 covers this appeal.
The government will hear both sides and render a final decision. Minister Bawankule expressed confidence that the amendment will cut down pending high‑court cases, saving citizens time and money. The statement of purpose also notes that it will release the state’s revenue that has been held up in court.
He added that the bill includes consequential changes to Section 32C and Section 53. “This bill will be important in ensuring speedy justice to citizens and easing administrative proceedings,” he remarked.
