New Delhi, Dec 27 (IANS) – The Supreme Court is set to review the Central Bureau of Investigation’s objection to a Delhi High Court ruling that postponed a life sentence and granted conditional bail to former BJP member Kuldeep Singh Sengar, who was convicted in the 2017 Unnao rape case.
According to the court’s causelist posted on its website, a vacation bench of three judges – Chief Justice Surya Kant CJI, Justice J.K. Maheshwari and Justice Augustine George Masih – will examine the matter on Monday.
The CBI has filed a petition against the Delhi High Court’s December 23 order, which allowed Sengar to seek suspension of his sentence while his appeal remains pending. Earlier, the CBI and the victim’s family indicated plans to challenge the High Court’s decision at the apex court.
In the Delhi High Court, the CBI had pressed hard against Sengar’s appeal, underlining the seriousness of the offence and the risks involved. A division bench led by Justice Subramonium Prasad and Justice Harish Vaidyanathan Shankar suspended Sengar’s life sentence, granting him conditional bail until the appeal is decided. The bail conditions require a personal bond of ₹15 lakh with three sureties of equal amount, prohibits Sengar from approaching the victim’s residence within a five‑kilometre radius, and restricts him to Delhi for the duration of the bail. The High Court warned that any breach of these terms will result in bail revocation.
The Unnao rape case sparked widespread outrage across the country. In December 2019, the trial court found Sengar guilty of kidnapping and raping a minor, sentencing him to life imprisonment plus a ₹25 lakh fine. The Supreme Court had earlier transferred all related proceedings from Uttar Pradesh to Delhi, instructing day‑to‑day trials.
Family members of the survivor and women’s rights activists have protested against the High Court’s suspension, asserting that the bail order “has shaken public faith” and sends a wrong message about crimes against women.
