Delhi Court Orders Police to Save CCTV Footage in BMW Hit-and-Run Case

In a key development in the tragic BMW hit-and-run case in Delhi, the Patiala House Court has stepped in to ensure vital evidence isn’t lost. On Thursday, the court issued a notice to the SHO of Delhi Cantonment Police Station, directing them to preserve CCTV footage from the accident site at Dhaula Kuan. This comes as the case involving the death of Navjot Singh, a Deputy Secretary in the Finance Ministry, heats up.

Judicial Magistrate First Class Ankit Garg also called on the Investigation Officer to bring the full case file to the next hearing. The matter is set for Friday, following an urgent application by the accused, Gaganpreet Kaur, who wants the CCTV clips saved right away.

Gaganpreet’s lawyers, Gagan Bhatnagar and Nikhil Kohli, argued that the police’s response to their plea was vague and unhelpful. They pointed out that during a media briefing, the Deputy Commissioner of Police (DCP) admitted to having watched the CCTV footage of the incident. The DCP even shared it with both the accused and the victim, they claimed. Yet, in their official reply, the police only mentioned issuing a notice to the relevant agency and waiting for a response—without confirming if they actually have the footage.

The lawyers specifically asked to preserve recordings from pillars 65 and 67 at the site. They highlighted how the victim’s initial statement mentioned a car hitting the bike, and the DCP later confirmed seeing the BMW accident footage. Now, four days after the crash, the police seem to be backtracking, saying they’re still awaiting details. With Gaganpreet’s bail hearing coming up, her team stressed the need for this evidence to be on record.

The complainant’s lawyer, Atul Kumar, didn’t oppose preserving the footage but made it clear it can’t be demanded by the accused at this point. Gaganpreet’s side pushed for the clips to be shown in court during the bail arguments, but the police reply stayed silent on whether the footage exists.

The court was clear: preservation is fine, but production isn’t up to the accused right now. "You can ask for saving the CCTV footage, not handing it over yet," Judge Garg said. He added that it’s the investigating agency’s call to bring it forward if needed for the case. The complainant’s counsel called the application "not maintainable," but the judge overruled that, focusing on keeping the evidence safe.

This BMW hit-and-run case has gripped Delhi since the fatal accident that killed Navjot Singh. Just a day earlier, on Wednesday, the same court gave Delhi Police more time to respond to Gaganpreet Kaur’s bail plea, pushing arguments to Saturday. Her judicial custody has been extended until September 27.
