Final photo of Arizona man killed during routine dental procedure resurfaces as family settles wrongful death suit

A photo snapped a week after a routine dental implant turned into an unexpected focal point for a wrongful‑death case that finally concluded this week.

On March 3, 2023, 40‑year‑old Derek Swanson, who was preparing for a new implant at Scottsdale Facial and Oral Surgery, posted a selfie in the dentist’s chair with the caption “Yesterday, new car. Today, implant! Fun never stops.” The picture, later shared by his parents, helped bring national attention to the circumstances that would soon lead to a tragic outcome.

According to the Maricopa County Medical Examiner, Derek suffered a severe brain injury when anesthesia failed to deliver enough oxygen during the procedure. He was placed on life support that afternoon and later died on March 10, 2023.

His mother, Brenda Swanson, told ABC15 that Derek had been eager to finish the work on his teeth, saying “He was so excited. He had fixed a lot of teeth, and they were looking really nice.” Brenda recalled that she sat in the waiting room the day of the surgery, hoping the patient would return. At one point, the front desk called Derek back, and he turned to her, winked, and said, “love you,” before walking back into the treatment room. “I just kept waiting and waiting, and Derek wasn’t coming out,” she added.

Years of unanswered questions culminated in a wrongful‑death suit filed by the Swansons against Dr. Derek Lamb, the clinic’s owner, and Scottsdale Facial and Oral Surgery. The plaintiffs asserted that the dentist’s anesthesia protocol—which omitted a licensed anesthesiologist—caused the oxygen deprivation that led to Derek’s fatal brain damage.

A settlement was reached this week for an undisclosed amount. While the exact figures remain confidential, the agreement resolves the claims that the dentist’s handling of the procedure was negligent.

The tragedy has also spurred the Swansons to push for legal reform. Arizona law currently allows dentists who possess the appropriate state permit to administer anesthesia without an anesthesiologist on site. The parents want to amend that provision so that a qualified anesthesiologist must be present for any dental surgery to reduce the risk of future complications. “We would like to not have another family go through what we had to go through and are going through and will be for the rest of our life,” Swanson told the outlet.

Their advocacy follows a pattern of concerns about anesthesia safety in dental settings, a topic that has drawn attention after several high‑profile incidents in recent years. The Swansons hope that their experience—and the unresolved questions that led to the settlement—will compel lawmakers to prioritize patient safety in dental care.
