UN rights envoy hails new investigative mechanism for justice in Afghanistan

In Kabul this week, the United Nations human‑rights council agreed, by consensus, to set up an independent investigative body for Afghanistan. UN Special Rapporteur Richard Bennett praised the decision as a “critical step toward truth, justice and accountability” for Afghans, according to local news outlet Khaama Press.

Bennett explained that the new mechanism will gather, keep safe and analyse evidence of serious human‑rights violations. The team will build case files that could lead to criminal prosecutions for those who commit international crimes. He said the body “must be part of a broader, integrated approach” to the Afghan crisis.

Key points underlined by Bennett:

  • Justice for victims: The mechanism reflects the bravery of Afghan victims and civil society who keep demanding accountability even as repression worsens.
  • Inclusive governance: He called for a government that respects women’s rights and Afghanistan’s ethnic and cultural diversity.
  • Speed and support: The UN envoy urged member states to fast‑track the mechanism’s launch and provide the money and technical help it needs.
  • Independence: Protecting the investigative process from outside pressure is vital.
  • Broader cooperation: Bennett welcomed parallel investigations by the International Criminal Court and suggested national courts should use universal jurisdiction.
  • Gender apartheid: He urged states to criminalise gender apartheid, a move he said is crucial to protect Afghan women and girls.

Bennett warned that the investigation alone won’t end the crisis. A full strategy that links criminal accountability with women’s rights, humanitarian aid and civil‑society protection is essential. He also stressed that Afghans—particularly women and youth—must play a safe, central role in shaping their country’s future.

Alongside the new mechanism, the Human Rights Council renewed Bennett’s mandate as the UN Special Rapporteur on human rights in Afghanistan. This move underscores the international community’s commitment to addressing the country’s ongoing human‑rights violations and supporting an inclusive, just future for all Afghans.
