BMW Accident Case: Court Gives Delhi Police More Time on Gaganpreet Kaur’s Bail Plea

In a latest update on the tragic BMW accident case in Delhi, the Patiala House Court has given the Delhi Police extra time to argue against Gaganpreet Kaur’s bail application. The incident, which killed Navjot Singh, a Deputy Secretary in the Finance Ministry, has kept everyone on edge as the legal battle heats up.

On Wednesday, the Judicial Magistrate First Class (JMFC) allowed the prosecution until Saturday to file their opposition to Gaganpreet Kaur’s bail plea. The Delhi Police already submitted their reply, but the court extended her judicial custody until September 27 to keep things moving.

The court also issued a notice on an application to preserve CCTV footage from the accident spot. This came from the accused’s lawyer, and the hearing is set for tomorrow. Such evidence could be key in unraveling what really happened in this high-profile Delhi road accident case.

During the hearing, senior advocate Ramesh Gupta, representing Gaganpreet Kaur, pushed hard for her bail. He called it a "simple accident case" and slammed the police for invoking Section 304 of the IPC, which deals with culpable homicide not amounting to murder. "That’s totally unnecessary," Gupta argued.

Gupta pointed out flaws in the investigation. He mentioned an interview with the Deputy Commissioner of Police (DCP) and questioned why the investigating officer hasn’t listed the DCP as a witness. He also raised concerns about an ambulance that arrived at the scene but didn’t take the injured to the hospital. "Shouldn’t that person face charges too?" Gupta asked.

The lawyer demanded that a DTC bus involved in the incident gets impounded and urged the police to investigate fairly. He noted issues like the unpaged case diary, which breaks legal rules, and called for two eyewitnesses at the spot to be added as witnesses.

Gupta dismissed police claims that Gaganpreet Kaur drove the injured to a far-off hospital, saying it doesn’t justify the serious charges against her.

On the flip side, the Delhi Police strongly opposed the bail. They said the first report came from the hospital, and despite Gaganpreet Kaur not being seriously hurt, she checked herself into the ICU. Taking the victim to a hospital 20 km away raises "serious doubts," they argued.

Atul Kumar, the lawyer for the victim’s family, echoed this. He highlighted how the accused chose a family-known hospital far from the scene, kept the injured on a stretcher while she lounged in the ICU for hours, and never called the police or an ambulance. "An army base hospital was just a minute away—why skip that?" Kumar questioned.

He pointed to the car’s high speed, noting the overturned BMW and deployed airbags as proof of the crash’s severity. This behavior, he said, shows the accused’s questionable conduct in the BMW hit-and-run-like incident.

The public prosecutor admitted he wasn’t ready to argue and requested time, which the court granted. As the Delhi BMW accident case unfolds, all eyes are on Saturday’s hearing for clues on Gaganpreet Kaur’s bail and justice for Navjot Singh. Stay tuned for more updates on this gripping story.
