CM Rekha Gupta attack: Delhi court directs police to provide FIR copy to accused
A Delhi court has ordered city police to hand over a copy of the First Information Report (FIR) to the man accused of attacking Delhi Chief Minister Rekha Gupta. The ruling came from Judicial Magistrate First Class Gaurav Goyal at Tis Hazari Court, who pointed to a Supreme Court judgment that gives every accused person the right to see the FIR.
The incident happened on August 20 during a public grievance session, or ‘Jan Sunwai,’ at the chief minister’s residence in Civil Lines. The attacker, 41-year-old autorickshaw driver Rajesh Bhai Khimji Bhai Sakariya from Rajkot, Gujarat, pretended to be a complainant. He passed some papers to Gupta, mentioned a court case, and then launched the assault.
Police arrested Sakariya right away. They charged him with attempted murder, assault on a public servant, and obstructing official duties. In court, Sakariya asked for the FIR copy, claiming he never got it.
Police pushed back, saying the FIR was marked sensitive under a department order and that his request came too early or wasn’t valid. The Special Public Prosecutor suggested sharing it only if Sakariya promised not to share it with anyone. But his lawyer argued the law doesn’t require any such promise.
After listening to both sides, the court sided with Sakariya. It rejected the police arguments and ordered them to provide the FIR copy immediately.
Investigators also uncovered Sakariya’s past: He faces at least five cases at Bhaktinagar Police Station in Rajkot, though courts acquitted him in four of them. This Delhi assault case highlights ongoing security concerns around public officials in India.
