Rajasthan’s High Court just gave tax professionals and filers a much-needed breather. On Wednesday, the court pushed back the deadline for submitting tax audit reports to October 31, 2025, blaming glitches and delays in the income tax portal.
The decision came during a public interest litigation filed by the Jodhpur Tax Bar Association. A bench led by Justice Dr. Pushpendra Singh Bhati and Justice Bipin Gupta stepped in with an interim order. They told the Central Board of Direct Taxes (CBDT), part of the Finance Ministry, to make the extension official. The case heads back to court on October 27 for more updates.
Representing the association’s president, CA Ajay Soni, were Senior Advocate Dr. Vikas Balia and Advocate (CA) Pratik Gattani. They highlighted how the original September 30 cutoff was turning into a nightmare. With 3.6 million audit reports still pending across India, wrapping them up in time was simply impossible.
As of September 23, only about 400,000 reports had been filed nationwide—way below the usual 4 million annual average. The team pointed to the Income Tax Department’s slow rollout of key tools as the main culprit. The utility for Form 3CD, essential for these audits, didn’t drop until July 18. Then, big changes hit on August 14, slashing the available time by more than half.
Taxpayers ended up with just 47 days to meet the September 30 deadline, instead of the full statutory period. For regular audit filings, that meant 135 days left rather than 244. Income tax return (ITR) deadlines for audited cases shrank to 112 days from 214, and transfer pricing cases got squeezed to 139 days from 244.
The Jodhpur Tax Bar Association stressed how these income tax portal problems unfairly piled extra stress on everyday filers and pros. Similar calls for relief are echoing from tax groups all over India, pushing for fixes to avoid penalties and chaos.
