Sufi Leader Appeals for Unity After Supreme Court Stays Key Waqf Act Provisions

In Moradabad, Uttar Pradesh, Bharatiya Sufi Foundation’s national president Kashish Warsi made a strong call on Monday for political parties to avoid exploiting the Supreme Court’s recent interim order on the Waqf (Amendment) Act 2025. He urged everyone to respect the ruling and trust India’s justice system, just like the community did with the Babri Masjid-Ram Janmabhoomi verdict.

Warsi didn’t hold back in criticizing Waqf boards across India. "These boards haven’t done enough for people’s welfare," he told . He pointed out how they’ve allegedly seized private properties instead of using Waqf funds for real help—like education, healthcare, and housing for Muslims. "If that money went to good use, no Muslim child would struggle for school, or families beg for Ayushman cards or PM Awas Yojana benefits," Warsi said. Still, he expressed full faith in the government to set things right.

The Muslim community challenged the Waqf Amendment Act in the Supreme Court, and the top court responded with a balanced interim order. It refused to halt the entire law but paused specific provisions until a final decision on its constitutional validity. A bench led by Chief Justice BR Gavai and Justice Augustine George Masih focused on protecting certain sections.

Key stays include:

  • The rule requiring someone to practice Islam for five years before creating a Waqf. This holds until clear rules define what counts as a "practitioner of Islam."
  • The part letting district collectors decide if Waqf properties encroach on government land.

The court, however, kept the registration mandate intact, noting it’s not new—it existed in the 1995 and 2013 Waqf laws too.

Warsi emphasized staying calm and united. "Don’t celebrate or mourn this order— just follow it to show faith in our system," he said. He warned against political games, adding that the Muslim community should spot true friends from foes. On a positive note, he highlighted India’s deep roots in communal harmony. "These roots are strong and will stay that way. Don’t let anyone shake them."

The Waqf (Amendment) Bill 2025 got President Droupadi Murmu’s approval on April 5, after intense debates in Parliament. As petitions challenging its validity continue, Warsi’s message underscores the need for trust and progress amid the Waqf Act controversy.
