Himachal MLA booked under Pocso Act on woman’s complaint

In Shimla on Saturday, police recorded a formal complaint that Himachal Pradesh’s own BJP legislator, Hans Raj, is alleged to have sexually assaulted a woman while she was a minor. The case was filed under the Protection of Children from Sexual Offences (POCSO) Act, specifically Section 6, which covers aggravated penetrative sexual assault. Law enforcement also accused him under Section 69 of the Bharatiya Nyaya Sanhita, which criminalises sexual intercourse obtained by deceit.

Hans Raj serves the Churah constituency in Chamba district. The woman first filed her claim on Friday evening at the local Women’s Police Station. After giving her statement in court under Section 183 of the Bharatiya Nagrik Suraksha Sanhita, officials registered an FIR.

A week ago, the woman live‑taped a seven‑minute Facebook video accusing the MLA and his aides of sexual exploitation and intimidation. She said the alleged assault happened when she was a minor and that she feared for her life. She also claimed the party’s staff had threatened her family, kidnapping her father, damaging phones, and threatening to burn their house.

Hans Raj responded with a video in which he called the accusations “baseless” and “politically motivated.” The woman’s father told reporters that the MLA’s supporters had been aggressive, and that the MLA’s office pressured them not to file the case.

Earlier, the same victim had filed an FIR against Hans Raj last year, accusing him of harassing her over the phone and requesting explicit photos. At that time, she did not claim rape, and later withdrew the statement. The current complaint is the first time she alleges sexual abuse as a minor.

Law enforcement is treating the case with high priority. The investigation will examine the woman’s claim, the video footage on social media, and any other evidence that could link Hans Raj to the alleged crime. The outcome of the investigation will be watched closely by supporters, critics, and those who seek justice for children’s rights in the state.
