Severity of allegations not sole ground for denying bail, says Delhi Court while granting relief to Samir Modi

A Delhi court has granted bail to businessman Samir Modi in a high-profile rape case, stressing that judges must look at the full picture rather than just how serious the charges sound. This decision from the Saket court in New Delhi highlights key issues in bail hearings for sexual assault allegations.

Additional Sessions Judge Vipin Kharb made the call, pointing out that claims of forced consent—due to the accused’s supposed dominance or promises of marriage—can only be proven during the actual trial when witnesses testify. “No need for police custody to sort that out,” the judge added.

Modi now faces strict rules to stay out of trouble. He can’t leave India without court approval, must show up for every trial date to keep things moving, and is barred from contacting the complainant, her family, or any witnesses. He also promised not to mess with evidence or get involved in any crimes.

In a statement after the ruling, Modi’s lawyer, Simran Singh, shared more details on the arrest. Delhi Police filed an FIR on September 10, 2025, and picked Modi up at the airport on September 18 without digging into the claims first. It all started when an Look Out Circular (LOC) popped up illegally as Modi headed to London for a scheduled meeting on September 14—he even had a return ticket for the 18th. Officers grabbed him at 7 a.m. that day, held him in police custody, then moved him to judicial custody.

Today, the sessions court set him free on a Rs 5 lakh bond. The prosecution alleges Modi coerced and sexually exploited the woman from 2019 right up to August 2024. But Modi’s side fired back, saying he had already complained to a senior police officer about ongoing blackmail. According to the statement, the woman demanded Rs 50 crore, then dropped it to Rs 15 crore, and later asked for a house and a car—threatening a rape case if he didn’t pay up. Modi backed his complaint with evidence like WhatsApp chats.

Singh wrapped up by noting the case is still under judicial review. “We trust India’s courts completely and will use every legal option available,” she said. She also urged the public to respect the privacy of Modi, his wife, and their two young daughters, who are dealing with a lot of pain from the public spotlight.

This bail ruling in the Samir Modi rape case from Delhi has sparked talks about fair investigations and quick arrests in India, especially when blackmail claims enter the mix. The trial ahead will test these serious allegations head-on.
