SCBA condemns advocate’s misconduct against CJI, warns against assault on judicial independence

New Delhi – The Supreme Court Bar Association (SCBA) has slammed the actions of an attorney who stormed a hearing in the courtroom of Chief Justice of India, Justice BR Gavai. In a statement released Friday, the SCBA called the lawyer’s behaviour “reprehensible” and expressed shock at what it described as a serious breach of courtroom decorum and professional ethics.

The SCBA said the lawyer’s conduct was not only inappropriate for a Court officer but also challenged the independence of the judiciary itself. The association warned that such incidents damage public trust in the justice system and threaten the respect that keeps the Bench and the Bar aligned.

The outburst stemmed, according to the SCBA, from disputes over Justice Gavai’s remarks in the Khajuraho Vishnu Idol Restoration case. In the case, Justice Gavai urged respect for all religions and rejected misinterpretations of his statements. The SCBA said social‑media distortions of those remarks fueled the lawyer’s anger.

Despite the provocation, Justice Gavai remained calm, continuing his duties with dignity. The SCBA praised the chief justice for his restraint and reaffirmed its support for him and the entire judiciary, stressing that judicial independence must be protected at all costs.

The association urged legal professionals to uphold secularism, fraternity, and the rule of law, and to resist efforts that politicise the judiciary. It also criticized certain media outlets for “sensationalising” the incident and distorting the chief justice’s remarks, accusing them of inciting public outrage and undermining Court authority.

In closing, the SCBA said the offending lawyer holds only temporary membership in the association. It announced that disciplinary action is being considered, noting that freedom of expression is vital but must be exercised responsibly, especially by those who serve as officers of the Court. ()
